In a separate operation, the AFP charged a 38-year-old Eritrean national on 22 October 2025 with six counts of violating visa-imposed curfews and one count of failing to maintain an electronic monitoring device between 9 – 18 October. Officers also seized a small quantity of suspected methamphetamine at the time of arrest.

The offences carry penalties of up to five years’ imprisonment per count. The man appeared in Melbourne Magistrates’ Court the same day. The arrest follows an uptick in curfew non-compliance cases since electronic monitoring was expanded to certain bridging visa cohorts last year.

Mobility practitioners should note that failure to meet reporting or curfew requirements can trigger immediate detention and affect any subsequent employer-sponsored visa bids. Companies relying on contingent labour should maintain clear lines of communication about visa obligations.

Legal observers expect the case to test recent amendments that allow courts to impose cumulative sentences for multiple Migration Act breaches.
