Within hours of the Delhi High Court’s stinging rebuke of its procurement process, the Union government approached the Supreme Court. Chief Justice Surya Kant agreed on 17 July to list the matter for urgent hearing on Monday, 20 July 2026. Solicitor-General Tushar Mehta argued that the High Court’s order has caused “near-dysfunction” of passport and visa operations at Indian missions in Canberra, Singapore, Abu Dhabi and Kuwait City. He will ask the apex court to stay the judgment and allow interim functioning of existing service providers while the tender is re-evaluated. A stay would provide breathing space for expatriates: an estimated 1.9 million Indian nationals in the four jurisdictions rely on outsourced centres for time-sensitive matters such as newborn registrations, emergency certificates and document apostilles. Legal observers expect the Supreme Court to balance the public-interest need for uninterrupted services against procurement integrity. Possible outcomes include appointing a court-monitored committee to supervise a fresh tender, or granting a limited extension to incumbent vendors under stricter oversight. Companies running global mobility programmes should monitor Monday’s proceedings; any stay could trigger a rapid reopening of appointment calendars at VFS Global and other providers, necessitating swift re-scheduling of employees’ applications.
