The Department of Home Affairs has registered the Migration Legislation Amendment (Arrangements for Child Visa Applications) Instrument 2026 (LIN 26/100), effective 22 September 2026. While the amendment appears minor—updating the postal address and clarifying application clauses—it matters for practitioners because it resets the legal footing for subclass 101, 102 and 802 (child and adoption) visas. Under Australia’s migration framework, even small drafting changes can affect validity of applications lodged after commencement. If an agent submits a paper application using a superseded address, the Department could deem the application invalid, delaying processing queues already stretched beyond 12 months for offshore child visas. The instrument also inserts a new section requiring that any future amendments made by LIN 26/100 apply only to applications lodged on or after commencement, resolving historical ambiguity about transitional cases. Agents representing split-family situations—where one parent remains onshore—must therefore double-check lodgement particulars. For employers this is indirectly relevant: work-visa holders often rely on child visas for family reunification. Invalid applications can force skilled staff to defer assignments or face schooling-year disruptions. Mobility teams should alert affected employees and, where necessary, fund re-lodgement fees. The change reflects Home Affairs’ push to modernise forms ahead of the full digitisation of the inbound passenger process. Expect further “tidy-up” instruments over coming months as Canberra aligns paper workflows with planned e-lodgement portals.
