Warsaw Border Guard detains six foreign nationals for overstaying and visa violations
Poland’s Nadwiślański Border Guard Unit confirmed that officers conducting routine residency-status checks across Warsaw on 6 October apprehended six foreign nationals who had no legal basis to remain in the country. The group comprised two Ukrainians and citizens of Vietnam, Uzbekistan, Brazil and Belarus. Four had ignored earlier negative decisions on asylum or temporary-stay permits; one Brazilian traveller had exceeded the 90-day visa-free limit; and one Ukrainian national had failed to comply with a previous return order. All six were processed under Poland’s Foreigners Act. Five received administrative return decisions that carry re-entry bans of between six months and three years for the entire Schengen Area. The sixth individual was escorted to the Polish-Ukrainian border and handed over to the Ukrainian authorities to execute an existing deportation order. The operation underscores the Border Guard’s intensified post-summer compliance sweeps in major Polish cities. Since January, Warsaw units have carried out more than 4,800 spot checks of workplaces, hostels and public-transport hubs, resulting in 312 administrative return orders—up 12 % year-on-year. For employers, the arrests serve as a reminder to keep up-to-date copies of employees’ residence permits and to notify voivodeship offices promptly of contract changes. Travellers relying on visa-free stays should track their Schengen-area days carefully; Polish authorities increasingly pair mobile document scanners with the EU’s Entry/Exit System data to flag over-stayers in real time. Companies bringing in short-term project staff are advised to build a compliance buffer (at least five spare Schengen days) and to use Poland’s fast-track Business Harbour visa where possible. Legal advisers expect even stricter enforcement once ETIAS pre-travel authorisation becomes operational next year.
