Foreign Office minister Stephen Doughty and EU Commissioner Maroš Šefčovič signed a far-reaching treaty in Brussels on 14 July that integrates Gibraltar into key parts of the Schengen acquis while maintaining UK sovereignty. Once provisionally applied from 15 July, Spanish border guards will perform Schengen entry checks at Gibraltar’s airport and port, removing the need for passport stamping at the land frontier and enabling true free movement for the 15,000 cross-border workers who commute daily. The deal also clears the way for direct Schengen flights from Gibraltar to European destinations such as Madrid, Milan and Frankfurt—routes that airlines have said they could launch as early as next summer season given slot availability. For goods, a simplified customs regime will allow ‘green-lane’ movement of most consignments with randomised risk-based inspections, reducing average clearance times from 45 to 10 minutes. Businesses with staff in Gibraltar or southern Spain stand to gain significantly. Employers will no longer need to budget for multiple-entry visas or frontier queue delays, and assignment packages can be redesigned around a much larger commuting catchment. Gibraltar’s government expects the agreement to add 15 percent to GDP over five years by unlocking logistics, tourism and remote-gaming growth. The treaty must still be ratified by the European Parliament and the UK Parliament, but both executives will apply it immediately through provisional measures. Companies should review posted-worker notification obligations, as Spain intends to enforce EU Posted Workers Directive requirements for Gibraltar-based firms that send staff to mainland projects.
