A little-noticed clause in the 2024 UK–France Joint Statement on Migration stipulates that the so-called “one in, one out” returns deal – under which one irregular migrant is sent back to France for every person accepted into the UK’s asylum system – will lapse on 1 October 2026 unless both governments agree a written extension. With just days to go, neither Paris nor London has confirmed renewal, according to a 25 September briefing for immigration advisers. French officials have signalled they would prefer to fold the bilateral accord into a broader UK–EU framework, while UK ministers maintain that separate talks are “constructive”. About 1,400 people have been removed to France since the mechanism began, representing roughly four per cent of arrivals. If no extension is reached, removals could be paused from next week, forcing the Home Office to detain return-eligible migrants for longer or release them on immigration bail – both costly options. For employers, the bigger issue is political: a breakdown would increase pressure on the Government to tighten legal migration routes further, potentially affecting sponsor-licence policy and settlement thresholds. Businesses with transferees awaiting asylum decisions should watch for updated Home Office operational guidance. Travel managers may also see fresh checks on coaches and commercial ferries as French authorities brace for any surge in attempted crossings after the deadline. Negotiators have until midnight on 30 September to file an exchange of letters. Even a short administrative extension would avoid an abrupt cliff-edge, but officials acknowledge that parliamentary scrutiny on both sides is complicating the timetable.
