DHS Grants Last-Minute TPS Reprieve for 100,000 Ukrainians and 1,800 Sudanese
Hours before Temporary Protected Status (TPS) for Ukrainians and Sudanese was due to expire on October 19, the Department of Homeland Security quietly announced that beneficiaries “retain protection” until a formal decision is issued. The move spares roughly 101,000 Ukrainians and 1,800 Sudanese from immediate deportation and job-loss while Washington debates a longer extension. TPS allows nationals of countries experiencing armed conflict or natural disaster to live and work legally in the United States. Ukraine received TPS in April 2022 after Russia’s invasion; Sudan was designated in 2023 as civil strife intensified. The Biden administration repeatedly renewed both programs, most recently in January 2025, extending validity through this month. Advocacy groups had warned that failure to renew would force tens of thousands of workers—many in health care, tech and logistics—into unlawful status overnight. Although DHS gave no timeline for a final determination, officials indicated that work authorization will remain valid under 8 CFR 244.5 automatic-extension provisions. Employers should nevertheless flag expiring EAD cards for reverification once an official Federal Register notice is published—likely within the next two weeks based on past practice. For global-mobility teams, the reprieve means assignments involving Ukrainian or Sudanese TPS holders can continue uninterrupted. Companies sponsoring green-card applications for these employees should proceed; TPS holders may adjust status if otherwise eligible. However, travel abroad remains risky until DHS confirms re-entry rules, so business trips should be deferred unless mission-critical. Policy analysts note the administration’s pattern of eleventh-hour TPS actions—El Salvador received a similar short-term stay in September—arguing that predictable, timely notices would reduce HR uncertainty and humanitarian stress. Congressional Democrats have renewed calls to convert long-standing TPS populations to permanent residency, but prospects remain uncertain in an election year.
