The Department of Homeland Security (DHS) quietly issued a notice late on Monday, July 13, extending the validity of Employment Authorization Documents (EADs) for more than 1 million Temporary Protected Status (TPS) beneficiaries whose work permission was set to lapse this week. TPS recipients from Haiti now have until July 24, while nationals of Syria, Myanmar (Burma), Ethiopia, Somalia, South Sudan and Yemen may work legally until July 17. The extension, announced by U.S. Citizenship & Immigration Services (USCIS), buys the agency time to decide how it will implement last month’s Supreme Court ruling that allows the Trump administration to terminate TPS designations for Haiti and Syria. TPS was created by Congress in 1990 to give the Executive Branch discretion to let foreign nationals remain in the United States temporarily when their home countries cannot safely accept deportees because of armed conflict, natural disaster or other extraordinary conditions. Successive administrations have renewed designations regularly—often for decades—creating a large, legally authorized workforce that many U.S. employers have come to rely on. The July 13 notice is deliberately short-term. USCIS says it will “issue further guidance” once lower courts lift injunctions that have kept prior termination orders on hold; advocates expect new instructions within weeks. In the interim, employers should update I-9 records by attaching a copy of the Federal Register notice to expiring EADs and not re-verify affected workers until the new deadlines. Failure to do so could expose companies to discrimination claims under the Immigration and Nationality Act’s anti-discrimination provisions. For HR and mobility managers, the message is two-fold: prepare contingency plans in case TPS is formally ended later this summer, and communicate clearly with line managers to avoid unwarranted terminations. Some companies are already exploring alternative visa options—such as humanitarian parole or nonimmigrant sponsorship—for key TPS talent.
