The Department of Homeland Security has reinstated the 2019 “public charge” regulation, once again allowing adjudicators to deny adjustment-of-status applications if an immigrant is deemed likely to rely on certain public benefits such as Medicaid, housing vouchers or food stamps. The revived rule, unveiled on 16 July, takes effect 18 September 2026. Under the standard—struck down in 2022 during the Biden administration—USCIS officers assess an applicant’s age, health, family status, education, assets and past benefit use to gauge future dependence on government support. Receipt of defined benefits for more than 12 months in any three-year period is considered “heavily weighted” evidence of inadmissibility. Family sponsors must still sign Form I-864 affidavits of support, but the new rule places greater emphasis on the intending immigrant’s own income and employability. Exceptions remain for refugees, asylees, Special Immigrant Juveniles and certain humanitarian categories. The business community fears knock-on effects: multinational employers that subsidise employee healthcare may need to document private-insurance coverage more rigorously, and corporate relocation programs will have to brief assignees on benefit usage that could jeopardise permanent residency. Immigration advocates predict a chilling effect on mixed-status families accessing entitled benefits, while several states are preparing legal challenges alleging administrative overreach. Companies sponsoring employment-based green cards should review onboarding questionnaires and consider adding attestations regarding public-benefit history to mitigate future Requests for Evidence (RFEs).
