The guidance sprang from the 2025 executive order "Ending Taxpayer Subsidization of Open Borders," which sought to broaden the 1996 welfare-reform law’s restrictions. In his opinion, Judge Mary McElroy ruled that the agencies exceeded statutory authority and failed to follow rule-making procedures, echoing arguments from a coalition of 17 states and several advocacy groups. While primarily a public-benefits case, the decision matters to global mobility because many corporate assignees rely on community services—from early-childhood programs to domestic-violence shelters—during relocations. Had the federal rule stood, states would have imposed additional document checks that could have deterred lawful permanent residents and mixed-status families from seeking assistance, complicating duty-of-care obligations for employers. The ruling may also influence upcoming litigation over the DHS public-charge regulation that took effect September 18. Attorneys say the court’s reasoning—particularly its emphasis on statutory silence—could be invoked to challenge other benefits-related immigration rules. The Justice Department has not announced whether it will appeal, but Illinois officials urged the administration to abandon similar verification initiatives, calling them “bureaucratic red tape that harms children and public health.”
