Government rejects calls to cap study permits by nationality, citing Charter rights
Ottawa has formally rebuffed a Parliamentary committee’s suggestion to set country-specific quotas on study permits for nationals with high asylum-claim or overstay rates. In its response to the House of Commons Citizenship and Immigration Committee’s April 2026 report, the government states that any rule limiting access to the International Student Program on the basis of nationality would contravene section 15 of the Canadian Charter of Rights and Freedoms, which prohibits discrimination based on national or ethnic origin. The committee had argued that targeted caps could curb what it saw as disproportionate abuse from a handful of source countries. IRCC instead pointed to a suite of universal measures rolled out since 2024 – including higher financial requirements, a national intake cap and tougher compliance rules for designated learning institutions – which it says are already driving down in-Canada asylum claims by study-permit holders. Officers will continue to use risk indicators and fraud-pattern data when assessing individual files, but the department insists every applicant must receive a merit-based decision untethered from their passport’s colour. The response also highlights new enforcement powers, effective November 2024, that allow IRCC to warn or suspend schools found facilitating abuses, thereby shifting responsibility onto institutions rather than students’ countries of origin. For higher-education recruiters, the decision preserves access to fast-growing markets that might have been throttled by a quota. Yet it comes with a warning: future financial-proof hikes and a revamped designation framework, slated for January 2027, will keep the pressure on both schools and students to demonstrate genuine study intent. Mobility planners should advise prospective students to bolster ties to home, clarify post-study plans and meet the escalating funds threshold – now $22,895 for a single applicant – to avoid refusals. The government accepted, in whole or in part, all other committee recommendations, including expedited renewals for graduate students and closer provincial alignment of post-graduation work-permit eligibility with labour-market needs. Institutions that fail to meet the new compliance metrics risk a one-year suspension from admitting new international students – a penalty far more immediate than any abandoned nationality cap.
