A US federal judge in Washington, DC issued a preliminary injunction in the early hours of July 15, 2026 blocking the Trump administration from enforcing a visa-restriction policy that targeted foreign researchers who study online disinformation and hate speech. The Coalition for Independent Technology Research, whose membership includes academics from Brazil’s Fundação Getulio Vargas (FGV) and the University of São Paulo, argued that the policy chilled academic freedom and jeopardised ongoing fieldwork in Silicon Valley. Chief Judge James Boasberg ruled that the State Department’s criteria—announced in May by Secretary of State Marco Rubio—likely violate First-Amendment free-speech protections because they condition visa issuance on viewpoint. Under the now-suspended guidance, consular officers could deny or revoke visas if applicants were deemed “complicit in online censorship,” a definition critics say was broad enough to capture fact-checkers and content-moderation scholars. The injunction is a major relief for Brazilian think-tanks and tech companies that routinely send data-science staff to the United States for short-term research stays or H-1B transfers. Several multinationals told Global Mobility News that they had paused July deployments over fear employees could be caught in secondary screening. With the court order in place, travel can resume while litigation continues, but mobility teams are advised to include a copy of the ruling in travel documentation and monitor further announcements from US consulates in Brasília, São Paulo and Rio. Legal experts caution that the administration may appeal, which could re-introduce uncertainty ahead of the US academic year. Brazilian universities partnering with US labs should therefore file visa petitions promptly and consider contingency plans such as remote collaboration hubs in Mexico City or Toronto.
