Judge Orders Continued Detention of Venezuelan Driver Shot by ICE Agent in Texas
A federal magistrate in Austin ruled late on September 30 that Leonardo Pérez, a Venezuelan national and food-delivery driver, must remain in ICE custody while prosecutors pursue assault charges stemming from a controversial traffic-stop shooting earlier this month. The case has ignited local protests and renewed criticism of aggressive immigration enforcement tactics in urban areas. For employers, the incident spotlights liability exposure when gig-economy or vendor workers lack clear immigration status. Companies contracting last-mile delivery services may see work stoppages if drivers avoid certain routes, fearing encounters with ICE’s Enforcement and Removal Operations (ERO) teams now active far from the border. The court also denied Pérez a bond hearing under the same mandatory-detention rule the Supreme Court will review next year. Defense counsel argue that without bond, Pérez cannot continue medical treatment for gunshot wounds or provide for his U.S.-citizen child. Corporate counsel following the case say a ruling in Pérez’s favor could have set a precedent for injured detainees seeking humanitarian parole. Mobility and procurement managers should audit vendor contracts to confirm that insurance covers immigration-related delays and to ensure subcontractors comply with Form I-9 rules. They should also monitor local law-enforcement task-forces that include ICE agents, as such partnerships may expand random ID checks in workplace parking lots. A pre-trial hearing is set for November 18. If charges are dropped, Pérez could still face removal—another reminder that criminal-case outcomes do not always resolve immigration status.
