The bill lays down a detailed legal framework that would allow the Federal Office for Migration and Refugees (BAMF) and local immigration authorities to train and deploy AI systems across the entire asylum- and residence-permit lifecycle. According to the explanatory memorandum, the objectives are faster case-handling, harmonised decision-making standards country-wide and earlier detection of document fraud. Among the headline measures are: (1) permission to use large data sets – including pseudonymised personal data – to train machine-learning models; (2) an automated “process-monitoring” tool that flags bottlenecks in real time; and (3) an AI-supported verification engine that can cross-check statements made in visa, Blue Card or asylum applications against open-source information when concrete doubts exist. A built-in “human-in-the-loop” clause requires a civil servant to confirm any negative decision suggested by an algorithm, mirroring safeguards in the EU AI Act. For corporate mobility managers the reform could shorten processing times for work-permit renewals and Blue Card applications—areas that still suffer from multi-month backlogs in some Länder. BAMF expects a 25 % productivity gain once the system is fully rolled out in 2029, freeing staff for complex casework. Critics from the opposition Die Linke warned of “algorithmic bias” and demanded stronger audit rights for applicants, while the business-friendly FDP argued the bill should go further by introducing an online self-service portal for Opportunity Card holders. If adopted, KIMVG would dovetail with Germany’s broader Fachkräfteeinwanderung reform and the upcoming EU Entry/Exit System. Companies employing large numbers of third-country nationals—IT, engineering and healthcare in particular—should monitor the legislative timetable: the Interior Committee is due to hold expert hearings in November, and the government hopes for final passage by April 2027 so that pilot projects can start before the year-end. Practically, HR departments should prepare for more data requests from authorities (e.g., structured employment information) and consider how to integrate with the forthcoming API-based submission channels. Early adopters may benefit from priority lanes similar to those in the digitalised customs sphere.
