The migration sector is still digesting sweeping changes that took effect on 2 October 2026, banning most holders of existing Student visas from lodging their next application while in Australia. A detailed analysis published on 11 October by specialist consultancy Migratio clarifies the regulatory instruments—three in total—that underpin the reform and sets out who is, and is not, exempt. Under the new rules, current subclass 500 visa-holders must submit any subsequent student-visa application offshore and remain offshore until grant; they will no longer receive a bridging visa. Seventeen other temporary-visa categories—including Working Holiday (417/462) and Temporary Skill Shortage (482) holders—are now completely barred from applying for a Student or Student Guardian visa onshore, closing a pathway long used to extend stays. Universities and vocational colleges face immediate enrolment-management challenges. International students finishing one course and hoping to articulate into another must factor in overseas travel time and additional costs. Providers unable to issue confirmations of enrolment fast enough risk losing applicants who decide to study in Canada or the UK instead. Education agents will need to update marketing materials and ensure prospective students budget for at least one return flight. The offshore requirement also affects employers offering internships or part-time roles: students who leave Australia to renew their visas will not have work rights until re-entry. Mobility teams should confirm whether enterprise agreements allow for unpaid leave during visa processing and should communicate timelines clearly to line managers. Key exemptions remain for Defence and Foreign Affairs scholarship recipients, doctoral candidates, school students and those affected by provider default. Migratio advises all stakeholders to confirm the latest legislative instruments—LIN 26/102 and LIN 26/087—and to track potential parliamentary disallowance motions that could still unwind elements of the reform.
