Belgian parliament postpones vote on controversial home-entry powers to detain migrants
Belgium’s Chamber of Representatives has again delayed a plenary vote on draft legislation that would allow law-enforcement officers, with a judge’s authorisation, to enter a private residence to apprehend foreign nationals under a final removal order. The bill, introduced on 3 June 2026 by Migration Minister Anneleen Van Bossuyt and Justice Minister Annelies Verlinden, has cleared committee stage but is now on hold for additional legal scrutiny following objections from privacy advocates. Proponents argue that existing rules make it almost impossible to enforce deportations when individuals refuse to open the door, undermining the credibility of Belgium’s migration system. The draft limits home-entry to cases posing a public-order or national-security risk and requires approval from an investigating magistrate, mirroring search-warrant safeguards in criminal law. Rights groups, however, warn that the measure blurs the line between immigration control and criminal enforcement, potentially deterring undocumented families from cooperating with authorities. They also question whether judicial oversight can be meaningful in fast-moving removal operations. For employers of highly mobile staff, the political tussle is noteworthy because it highlights Belgium’s broader pivot towards stricter enforcement – a trend that could translate into more workplace inspections and tighter document checks. Companies sponsoring foreign talent should therefore review their compliance programmes and ensure affected employees keep residence permits current to avoid falling into the bill’s target group. Parliamentary leaders have not set a new vote date, but the issue is expected to resurface after the autumn recess, leaving multinational mobility teams in limbo over the final enforcement landscape.
