Construction sector moves to top priority under new Ministerial Directions 121 & 122
Just four weeks after coming into force, Ministerial Directions 121 and 122 are already reshaping Australian skilled-visa queues, according to immigration specialists at Roam Migration Law. In an analysis published 15 October, the firm notes that applications nominating construction occupations now sit in ‘Priority 1’ for both the forthcoming Skills-in-Demand visa (proposed Subclass 482 replacement) and permanent employer-sponsored subclasses 186/187, leap-frogging non-priority sectors regardless of whether the worker is on- or off-shore. Previously, Direction 119 ordered files primarily by applicant location, disadvantaging offshore hires. By ranking priority sectors ahead of location, the new regime removes that structural lag. The construction category encompasses trades groups 33 and 82, construction managers (1331), civil engineers (2332) and even newly added engineering-manager and drafting-technician roles. For project-driven industries battling acute labour shortages, the change is more than semantic. Published processing-time dashboards already show July-2024 offshore construction nominations being allocated ahead of on-shore applications lodged months later under the old rules; practitioners expect the backlog to clear rapidly over coming months. However, faster sequencing does not waive substantive requirements. Sponsoring firms must still meet market-salary and training-levy obligations, while visa applicants require full skills assessments and licensing where applicable. Employers scaling up their sponsorship volume are urged to audit compliance systems before lodging multiple nominations. In the medium term, workforce planners in resources, agriculture, health care and teaching — sectors likewise elevated — should map critical roles against the priority occupation list to exploit the faster lane and mitigate project delays.
