An interim final rule (IFR) published in the Federal Register on February 6 has taken effect as of March 9, 2026, dramatically shortening and streamlining appellate practice before the Board of Immigration Appeals (BIA). The DOJ regulation slashes the time for non-detained respondents to file appeal briefs from the long-standing 30-day window to just 10 calendar days. Briefing for detained cases is now simultaneous, eliminating the staggered schedule that often stretched cases for months. The rule also expands the circumstances under which a single Board member may summarily affirm an immigration judge’s decision, and it codifies stricter page limits. DOJ argues the changes are essential to reduce a BIA backlog that topped 255,000 cases in FY 2025, but immigrant-rights groups warn that the compressed timetable will deny due-process rights to pro-se respondents and overburden already-stretched counsel. Employers and foreign nationals should pay close attention: a negative labor-certification revocation or family-based denial can now become final in as little as two weeks if no timely brief is filed. Companies that sponsor workers should review internal escalation procedures to ensure that any adverse decisions are transmitted to counsel immediately. Stakeholders have until April 8 to submit comments, but because the rule is already in force, practitioners must follow the new deadlines now. EOIR has released an FAQ and updated the e-Registry portal; mobility teams should circulate the new timelines to outside counsel and HR case managers without delay.
