Ukrainian national Oleg Bondar, a long-term Auroville resident, sought a visa for his daughter so she could visit her 87-year-old grandfather undergoing cardiac treatment in Tamil Nadu. After an e-tourist visa request was denied—partly because the daughter had earlier overstayed an Indian visa—the father petitioned the court for humanitarian reconsideration. Justice Anita Sumanth declined to intervene, ruling that the daughter must follow the “regular visa process” at the Indian Mission in Kyiv. The court accepted the government’s assurance that the embassy in war-torn Ukraine is operational and can process applications expeditiously. It also noted that the applicant may pay any prior overstay penalty at the Mission. For global-mobility leaders the message is clear: prior compliance history matters, and e-visa denials cannot usually be sidestepped through litigation. Where an assignee’s family member has overstayed in the past, organisations should budget extra lead-time for regular-visa scrutiny, including the possibility of personal interviews and penalty payments. The decision further illustrates how India differentiates between the streamlined e-visa system—designed for bona-fide short visits with clean records—and the more rigorous regular-visa channel that allows officials to scrutinise past violations. Companies arranging emergency travel for relatives of expatriates in India should consider engaging with the nearest Indian Mission early, supplying medical documentation and undertaking letters to speed up processing within the conventional framework. Finally, the judgment highlights operational resilience at Indian embassies: despite security conditions in Ukraine, consular services remain functional, albeit with longer queues. Employers may wish to maintain updated mission-status trackers when planning travel from conflict zones.
