In a 20-minute first reading late on 8 October, the German Bundestag discussed the government’s draft Act on the Use of Artificial Intelligence in Migration Administration (KIMVG). The bill seeks to give asylum and residence authorities clear legal cover to train and deploy AI systems for document verification, fraud detection, workflow analysis and decision support. If adopted, the Interior Ministry will be empowered to process personal data—potentially including open-source intelligence from social media—when “necessary to clarify justified doubts” about an applicant’s statements. The draft also mandates an automated “procedure-monitoring” tool to identify bottlenecks and inconsistent decision patterns across Germany’s fragmented Ausländerbehörden. For global employers the upside is faster, more predictable case-handling; pilot projects in Saxony have already slashed Blue Card processing times from 12 to 6 weeks by auto-filling forms. Yet the proposal raises compliance questions around data minimisation and algorithmic bias. Companies sponsoring visas will need to audit their document packages carefully—AI flagging of minor discrepancies could trigger manual reviews and delays. The bill was handed to the Internal Affairs Committee, which will hold expert hearings in November. Data-protection authorities, migrant charities and tech vendors are expected to clash over safeguards, explainability and redress mechanisms. Mobility managers should watch for amendments on transparency obligations that could expose corporate submissions to new disclosure regimes. Assuming normal legislative pacing, the KIMVG could pass by mid-2027, coinciding with the EU’s own AI Act. Early engagement with local foreigners’ offices to understand planned pilot tools—particularly around e-ID verification and multilingual chatbots—will help HR teams adjust application playbooks before the big-bang rollout.
