Germany’s Federal Constitutional Court delivered a landmark decision on 24 July 2026 that strengthens the legal certainty of humanitarian admissions. The judges ruled that the Interior Ministry acted unconstitutionally when, in December 2025, it cancelled roughly 640 visa pledges that had been issued to particularly vulnerable Afghans after the Taliban takeover. The Court found the blanket cancellation to be “arbitrary state action” because officials had failed to weigh the individual circumstances of those affected. The case was brought by an Afghan mother and her two sons who had been promised protection under a 2021 “human-rights list.” By siding with the family, the Court clarified that once Germany has issued a concrete admission commitment it cannot simply be withdrawn en masse; any reversal must take account of each applicant’s situation and Germany’s constitutional duty to protect human dignity. Although the ruling does not force the government to admit the complainants, it obliges authorities to re-examine every cancelled case individually and to continue subsistence support for those stranded abroad until a lawful decision is made. Politically, the judgement is a setback for Chancellor Friedrich Merz’s tougher migration stance, introduced amid public pressure over irregular arrivals. The Interior Ministry must now choose between re-opening the human-rights admissions programme or spending months on individual reassessments that could again be challenged in the courts. Human-rights organisations welcomed the outcome, calling it a “victory for fundamental rights” and a reminder that administrative convenience cannot trump constitutional protections. For companies running global mobility programmes, the ruling underscores Germany’s continued commitment to the rule of law in immigration matters. Employers assisting Afghan assignees or dependants now have a clearer basis to argue that government promises — for example under humanitarian or skills-based channels — cannot be cancelled without due process. Immigration counsel advise affected workers to keep documentation of any admission pledges and to be prepared for renewed but case-by-case security checks. Practically, the decision may slow processing times at German consulates in Islamabad and elsewhere, as officials must revisit hundreds of files. Global mobility managers should therefore build additional lead-time into assignment planning for Afghan nationals and monitor further guidance from the Interior Ministry and the Federal Foreign Office.
