A landmark ruling by the Upper-tier Immigration Tribunal has forced the Home Office to reverse its refusal to grant entry clearance to two Palestinian mothers and their five young children who have been stranded in Gaza for more than a year. The judge found that officials had applied the department’s 2023 “unsafe journeys” policy so rigidly that it breached both the Immigration Rules and the U.K.’s obligations under article 8 of the European Convention on Human Rights, which protects the right to family life. Under normal refugee-family-reunion procedure, applicants must attend a visa-application centre (VAC) to enrol fingerprints and facial images. Gaza’s sole VAC closed after the October 2023 escalation in the Israel-Hamas war, leaving hundreds of approved applicants—including the two families in this case—physically unable to supply biometrics. Home Office guidance allows flexibility when VACs are inaccessible, but officials insisted the women and children first exit the war-zone to Jordan at their own risk and cost. The tribunal held that this effectively made the reunion route “illusory” and ignored the children’s best interests. The decision piles legal and political pressure on the government. Refugee charities estimate 250–300 similar cases are stalled. Lawyers say the ruling should compel the Home Office either to accept exceptional evidence without in-person biometrics or to facilitate safe evacuation for applicants. Failure to comply could trigger further judicial review actions as well as contempt-of-court proceedings. For U.K. employers the judgment is a reminder that dependent visas can still be obtained for refugees’ families, but processing times may remain unpredictable while the department revises its approach. Companies planning assignments for staff with refugee status should budget extra time for family-reunion applications and consider relocation support once relatives arrive. The case may also foreshadow wider reforms to the “unsafe journeys” policy ahead of the next Statement of Changes, expected later this autumn. In the medium term, immigration lawyers forecast that the Home Office will issue revised guidance clarifying when remote or deferred biometrics can be accepted. Multinationals with employees in conflict regions should monitor the forthcoming update closely; it could establish a precedent for other closed-VAC scenarios such as Sudan or Afghanistan.
