Under amendments enacted by the Strengthening Canada’s Immigration System and Borders Act on 26 March 2026, the Governor-in-Council may now issue Orders in Council (OICs) that cancel, suspend or vary large volumes of visas and permits, or freeze the intake of new and in-process applications. While IRCC already has authority to refuse or revoke individual files, the new mechanism enables program-wide action—akin to the pandemic-era COVID border orders—without the need for emergency health legislation. The Gazette notice cites scenarios such as future disease outbreaks, large-scale fraud or “geopolitical events that threaten the integrity of Canada’s immigration system” as potential triggers. For employers and foreign workers, the change represents a new layer of uncertainty. A single OIC could, in theory, pause entire categories such as study permits or provincial nominations, up-ending recruitment pipelines overnight. Immigration lawyers are advising clients to build contingency plans that include alternative work-authorisation options (e.g., CUSMA or intra-company transfers) and to keep digital copies of all approval letters in case physical documents are invalidated. The Gazette notes that any mass suspension order must specify scope, duration and review mechanisms, and that affected applicants would have access to judicial review. Still, the prospect of blanket cancellations raises reputational risks for Canada as a destination for global talent—particularly after last month’s Ebola-related suspension of 36,000 PR visas. Stakeholders have 30 days to submit comments. Multinationals should consider joining industry associations in calling for clear consultation thresholds and compensation provisions before an OIC can alter existing rights.
