Italian Senate Opens Final Debate on Decree-Law 100 Implementing EU Migration & Asylum Pact

Rome – The Italian Senate opened its 29 July 2026 plenary sitting by placing Government Decree-Law n. 100/2026 – the so-called “Migration & Asylum Pact alignment decree” – at the top of the agenda. The measure, adopted by the Cabinet on 12 June and already in force, must be converted into law by 11 August. It brings Italy’s legal framework into line with the package of EU regulations and directives that make up the New Pact on Migration and Asylum, formally adopted by the Union in May. During today’s general discussion, Interior Minister Matteo Piantedosi told senators that the decree “modernises the rules on international protection procedures, accelerates border screenings, and gives employers clearer pathways for the intra-EU re-allocation of foreign staff.” Key provisions create fast-track border procedures for manifestly unfounded asylum claims, allow early fingerprinting and Eurodac registration, and transpose the EU return-at-border regulation. A new inter-agency hub in Trieste will coordinate relocation requests from other Member States. For business immigration managers the decree is significant because it explicitly safeguards the work-permit quotas (Decreto Flussi) already granted to companies. Foreign employees whose asylum requests are rejected at the border will no longer occupy quota places, reducing the risk that corporate slots are consumed by non-eligible applicants. The text also clarifies that beneficiaries of the forthcoming EU Talent Pool may perform highly-skilled work in Italy without an additional national work permit. Opposition parties criticised what they call a “security-driven approach” and tabled a question of constitutionality centred on due-process guarantees for minors. Nevertheless, the governing majority has the numbers to pass the conversion bill unchanged, most likely at the 1 August confidence vote. Companies should therefore prepare for the decree’s procedural changes – especially the shorter deadlines (7 days) to respond to prefecture requests for supplementary documents when sponsoring a work visa. Practical Tip: HR teams should alert external counsel that border-procedure asylum denials will feed into the same centralised database that issues nulla-osta (work-authorisation clearances). Discrepancies between an assignee’s personal data in Eurodac and in the work-permit file could trigger automatic holds, so double-check spelling and passport numbers before filings.
