New Ministerial Direction 119 Re-orders Skilled-Visa Queue, Favouring On-Shore Applicants

A week after coming into force, Ministerial Direction 119 is already reshaping Australia’s skilled-migration pipeline. The Department of Home Affairs updated its processing-priorities webpage on Sunday to confirm that, from 25 July, nomination and visa applications supporting defence or law-enforcement roles lodged inside Australia receive first priority, followed by on-shore applicants in construction, health and teaching. Offshore applicants have been pushed to the back of the queue. The change replaces Direction 105, which for two years gave automatic priority to occupations on the Critical Skills List regardless of location. Migration agents say the new hierarchy is already visible: “Several on-shore engineers lodged in late July have progressed to further-assessment in under a week, while comparable offshore files from April are still untouched,” one Perth-based agent told Global Mobility News. For employers, the message is clear—bring prospective hires to Australia early, even on visitor visas, before lodging sponsorships. Relocation managers are also advising transferees to time visa renewals carefully; an applicant who steps outside Australia for a holiday now risks dropping several rungs in priority. Home Affairs argues the shift supports the government’s ‘backing Australian jobs’ agenda while still enabling critical offshore talent to enter. Critics counter that it disadvantages regional businesses that recruit directly from overseas and could lengthen waiting times for global talent streams that have been instrumental in filling tech shortages. Legal practitioners are watching for test cases: because Direction 119 applies retrospectively to applications already in the system, some candidates who sold homes or quit jobs overseas expecting quick grants now face extended uncertainty.
