Australian employers relying on the popular Skills in Demand (subclass 482) visa woke up to a new reality this morning. At 12:01 am, Ministerial Direction 121 (MD121) formally replaced the MD119 priority rules that had governed temporary-skilled visa processing since 2024. According to immigration law firm Rehman Sheriff Group, MD121 creates a five-tier queue that heavily favours applications linked to the construction, healthcare, teaching, agriculture, aquaculture, fishing and resources sectors, as well as those that support Australia’s law-enforcement and defence interests. The second-highest priority now goes to the Specialist Skills stream of the 482 visa—intended for highly paid professionals earning at least AUD 146,576—followed by on-shore applicants, certain standalone offshore applications and, finally, all remaining 482 cases. Practically, this means a nurse recruited for a regional hospital or an engineer hired for a critical minerals project is likely to see their visa assessed months earlier than a hospitality manager or digital-marketing specialist. For businesses, the change demands a rethink of recruitment timelines. The Department of Home Affairs is currently working on files lodged as recently as February 2026 for priority-sector roles but is still assessing offshore, non-priority cases from late 2025. Employers planning to mobilise staff for early-2027 projects must therefore map out whether the role qualifies for higher priority, whether the candidate can lodge on-shore, and which of the three 482 streams—Core, Specialist or Labour Agreement—best fits the job description. MD121 does not alter the substantive eligibility rules for the 482 visa: sponsoring companies must still meet salary, labour-market testing and training-levy obligations, and applicants must still satisfy skills, English-language and health requirements. However, it does change the order in which compliant applications are processed, which can make or break project start dates and contract bids. Immigration advisers are urging corporate mobility managers to audit upcoming assignments, flag roles that fall into MD121’s top two categories and ensure documentation is complete before lodgement. In a tightening labour market, being at the front of the queue could be the difference between winning and losing talent.
