Upper Tribunal orders Home Office to rethink Gaza family visa refusals
In a landmark decision handed down on 16 October 2026, the Upper Tribunal (Immigration and Asylum Chamber) ruled that the Home Office acted irrationally in refusing visit visas to two Palestinian families trapped in Gaza. The families had been unable to travel to an overseas visa-application centre to enrol biometrics—a requirement the department said was mandatory before officials could consider their applications. The Tribunal found that the ‘unsafe journeys’ policy, introduced after the refugee family-reunion route closed last year, failed to account for the impossibility of leaving Gaza safely. By insisting on biometrics first, officials placed the families in a Catch-22 and breached their Article 8 ECHR rights to family life. The judges ordered the Home Office to reconsider the applications urgently and devise a practical alternative for collecting biometrics, such as on-arrival enrolment or remote capture. While the judgment concerns humanitarian cases, it underscores the growing judicial scrutiny of biometric practicality across all visa categories. Corporates dealing with high-risk regions should note that inflexible biometric rules can now trigger litigation and delays. Legal commentators expect the ruling to influence ongoing policy discussions about mobile biometric teams—a reform that could eventually benefit business applicants in remote locations as well. The Home Office said it is “reviewing the judgment carefully.” Businesses with personnel in conflict zones should monitor forthcoming guidance for any temporary concessions on biometric enrolment.
