Logistics Firm Barred After Breaching Enhanced Supplementary Labour Scheme Rules
Wilson Logistics Limited has been hit with Hong Kong’s toughest sanction under the Enhanced Supplementary Labour Scheme (ESLS) to date. The Labour Department announced on 14 October that it has terminated processing of the company’s existing application to import workers and will refuse any new submissions for 12 months. An investigation found the firm provided false head-count data and failed to maintain the required 2:1 ratio of local to imported staff after earlier approvals were granted. The ESLS permits companies to hire overseas workers for hard-to-fill posts only after a four-week local recruitment drive and mandates ongoing compliance with head-count ratios, wage parity and accommodation standards. The decision is a warning to employers navigating Hong Kong’s tightening labour-import regime. Since the ESLS was revamped in 2025, periodic audits and surprise inspections have increased. Offending companies face withdrawal of permits, blacklisting and potential prosecution for furnishing false information under the Immigration Ordinance and Employment Ordinance. Industry groups say most logistics players rely on a small pool of imported drivers and warehouse operatives amid chronic shortages, but stress that cutting corners risks reputational damage and operational disruption. Competitors note that Wilson’s ban could delay peak-season fulfilment contracts and push freight volumes to other providers. Mobility and compliance teams should review internal governance around quota management, record-keeping and on-boarding of imported staff. The case underscores that labour-import flexibility comes with strict transparency obligations—and that regulators are prepared to enforce them.
