A lawsuit seeking to block the State Department’s freeze on immigrant-visa issuance for nationals of 75 countries hit a roadblock on Thursday when U.S. District Judge Trevor N. McFadden dismissed the case for lack of standing. The ruling, published Saturday, leaves in place a January cable that ordered consular officers worldwide to refuse all immigrant visas from countries on a public-charge watchlist while the department conducts a policy review. Judge McFadden found that most of the 80-plus plaintiffs had offered “no detail” about their pending visa applications and therefore failed to show concrete injury. The court also criticized heavily redacted declarations that obscured key facts. Plaintiffs have until August 24 to re-file a more specific complaint. Pending that deadline, consulates may continue scheduling interviews but are barred from issuing visas to affected nationals. For multinational companies, the pause complicates global talent flows—particularly for intra-company transferees from Russia, Brazil, Nigeria and Iran, all listed among the 75 countries. Human-resources teams should anticipate longer assignment lead times and consider third-country “visa routing” strategies where employees apply from non-restricted jurisdictions. Immigration attorneys note that the directive does not affect non-immigrant categories such as H-1B or L-1, but it does delay green-card processing for thousands of foreign executives and skilled workers. The dismissal also underscores the uphill battle litigants face when challenging consular policies under the doctrine of consular non-reviewability. Advocates are urging Congress to exercise oversight, arguing that the freeze functions as a de-facto travel ban. Until the case is re-filed—or the State Department completes its review—companies should track employees’ priority dates closely and explore alternative pathways such as EB-1 multinational-manager petitions filed from within the United States.
