The European Commission moved quickly on 1 October to calm legal doubts about the tit-for-tat border controls that Italy and Spain imposed in mid-August and have since renewed. Interior Commissioner Magnus Brunner told reporters in Luxembourg that both Rome’s screening of passengers arriving from Spain and Madrid’s reciprocal checks on travellers from Italy are “fully compatible” with Articles 25-28 of the Schengen Borders Code, provided they are proportionate and time-limited. Italy first reinstated controls on 2 August citing public-order risks linked to the Ceuta influx. Spain responded the next day with mirror measures. Business-travel groups complained that the uncoordinated action created bottlenecks in Milan, Rome, Madrid and Barcelona, where average passport-control times jumped from 3-5 minutes to 15-20 minutes during peak hours. Brunner’s statement offers legal cover for the latest 15-day extensions announced on 30 September, but he cautioned that any further prolongation beyond three months would require additional justification. The Commission has asked both states to submit weekly impact reports and to outline alternative risk-management tools—such as targeted police patrols—before 15 October. For mobility managers the clarification removes immediate uncertainty about the legality of the checks, but travellers should expect enhanced scrutiny at Italian and Spanish air and sea borders until at least mid-October. Companies moving staff between the two countries are advised to carry proof of accommodation and return travel to speed processing. The episode also illustrates how quickly Schengen can fragment in response to national security concerns, a factor global mobility programmes must now model into their travel-risk assessments.
