China’s State Council has enacted sweeping amendments to its Exit and Entry Administration Regulation, effective 15 September 2026, that significantly expand the government’s power to stop people at the border. The revised Article 12 empowers immigration officers to impose exit bans of six months to three years on citizens who, in the government’s view, have engaged in overseas activities that "endanger national or industrial security," including violations of technology-export laws. Foreign nationals who provide false information on visa applications or at ports of entry can also be blocked from entering China for up to five years. The rules are part of President Xi Jinping’s broader strategy to protect sensitive know-how amid intensified geo-tech rivalry with the United States. Consultancy Trivium China notes the regulation gives officials "far greater discretionary latitude" to evaluate what constitutes a threat, raising compliance questions for multinationals whose Chinese staff travel frequently for R&D or joint projects. Corporate mobility managers should expect stricter post-trip reporting requirements and pre-departure reviews for employees involved in dual-use technologies. Chinese nationals working in semiconductors, AI, aviation, biotech or cloud services may face enhanced scrutiny when applying for exit permits; employers are advised to document export-control compliance and obtain written confirmation that outbound travel is strictly business-related. The regulation also addresses a domestic concern: Chinese citizens lured overseas to engage in illegal gambling or telecom scams. Border officers can now refuse exit to anyone suspected of being recruited into such schemes, an authority aimed at curbing the social fallout of criminal syndicates operating in Southeast Asia. For foreign businesses, the main practical implication is uncertainty. Because the rule allows authorities not to notify affected travelers "if doing so could affect national security or a criminal investigation," exit bans may be imposed without warning. Companies are urged to add contingency clauses to travel insurance, maintain duplicate leadership for key roles, and review data-access protocols to minimise the risk that an employee’s laptop or phone contents trigger a last-minute travel block.
