Poonacha ruled that the power to extend or refuse a visa is ‘a sovereign discretion of the Indian state’ and that foreign nationals have no vested right to remain once validity lapses. The petitioner argued the order violated natural-justice principles because the FRRO did not hold a hearing and his university rustication, which deprived him of the bona-fide student certificate needed for renewal, was itself under challenge.
