The Immigration Law Practitioners’ Association (ILPA) has published updated Home Office guidance confirming that, from 22 September 2026, airlines, ferry companies and rail operators can be fined if a passenger who requires an Electronic Travel Authorisation (ETA) or other immigration permission arrives in the UK without it. The clarification, released on 5 October, ends months of speculation about how robustly carrier liability would be enforced once the UK’s digital-by-default border model went live. Under the revised scheme, carriers must integrate passport-data screening with the Home Office “permission to travel” API. Failure to deny boarding to an ineligible traveller can trigger civil penalties of up to £10,000 per passenger and operational reviews by Border Force inspectors. Penalties also apply if a traveller’s digital status cannot be verified because faulty data were transmitted. The measures mirror long-standing US ESTA and Canadian eTA enforcement and are designed to shift compliance upstream, freeing Border Security Command officers to focus on high-risk arrivals. For corporate mobility teams the message is clear: ensure that short-term visitors—including intra-company auditors, board members and conference speakers—apply for ETAs well in advance and that travel management companies transmit accurate Advance Passenger Information. Travel suppliers are scrambling to comply. Two major European low-cost carriers told ILPA that they have upgraded mobile-boarding apps to conduct real-time ETA checks, while Eurostar is piloting QR-code validation at St Pancras. Employers that charter private jets should note they, too, will be classified as “carriers” for liability purposes. Failure to adapt could result in travellers being refused boarding at overseas airports, causing costly delays to project kick-offs and client meetings. Best practice is to build an ETA prompt into pre-trip approval workflows and to keep screenshots of approval emails in case of system outages at departure gates.
