On 22 July 2026 the American Association of People with Disabilities (AAPD) issued a blistering statement condemning DHS’s final "public charge" regulation released five days earlier. The rule empowers immigration officers to deny admission, permanent residence, or even naturalization if applicants have ever used—or are "likely" to use—public benefits such as Medicaid, housing vouchers, or food assistance. Unlike the narrower 2020 version, the new standard removes quantitative thresholds and places decisions squarely in individual officers’ discretion. AAPD warns that the open-ended language will disproportionately harm disabled immigrants, who often require medical or support services upon arrival. Because officers may also consider benefits received on behalf of U.S.-citizen family members, mixed-status households could self-select out of programs like Medicaid to avoid jeopardizing a relative’s green-card case. From a global-mobility perspective, the rule could complicate long-term U.S. assignments that rely on employer-sponsored health plans that integrate with state Medicaid waivers for dependents with disabilities. Employers may need to document private-insurance coverage more thoroughly when filing adjustment-of-status applications and counsel relocating families on the heightened scrutiny. The regulation takes effect 18 September 2026 unless blocked by litigation. Multiple states, medical associations, and business groups are preparing lawsuits, arguing that an unpredictable standard will chill foreign investment and worsen healthcare outcomes by deterring preventive care. Until there is clarity, companies should flag employees and assignees whose cases might intersect with public-benefit usage and involve experienced counsel in drafting I-864 Affidavits of Support or Form I-485 public-charge declarations. HR should also communicate that employer-provided benefits remain excluded from the calculus, helping assignees make informed enrollment choices.
