UKVI tightens sponsor-licence compliance rules in major guidance update
UK Visas & Immigration (UKVI) has issued Version 16.0 of its cornerstone manual “Worker and Temporary Worker Sponsor Licensing: Maintenance,” highlighting a tougher approach to post-licence compliance. The 220-page document, updated on 20 October 2026, gives caseworkers expanded checklists covering civil-penalty records, insolvency searches and outstanding non-compliance actions before any change-of-circumstance request is approved. Key changes include mandatory ‘meta-audits’ of a sponsor’s historic Certificate of Sponsorship (CoS) usage and new time limits: employers must upload evidence within five working days of submitting an online amendment or face automatic rejection. Level 1 users who repeatedly miss deadlines can be forced to step down, and the guidance tells officers to escalate such cases for potential licence downgrading. Mobility managers will also notice stricter requirements when adding overseas entities to a licence—a change designed to police the Global Business Mobility route. Sponsors must now submit third-party accreditation certificates and proof of common-ownership structures to prevent shell-company abuse. For multinationals, the practical impact is two-fold. First, any corporate restructuring or name change must be reported far sooner than the historic 20-day window. Second, internal audit functions will need to retain HR records for at least six years, mirroring HMRC practice, to satisfy the new retrospective checks. Failure to comply risks suspensions that instantly invalidate sponsored workers’ permission to work, exposing firms to civil penalties of up to £60,000 per employee. UKVI says the reforms align with Home Office plans to digitise the sponsor management system next spring, promising real-time flagging of missing data. Sponsors are advised to download the new guidance, brief their key personnel and consider an external compliance health-check before the busy January recruitment season.
