Switzerland updates guidance on implementing EU Migration & Asylum Pact
The State Secretariat for Migration (SEM) quietly updated its English-language factsheet on the EU Migration and Asylum Pact on 21 October, clarifying how the ten EU legal texts adopted in June will be transposed into Swiss law. Although Switzerland is not an EU member, it is bound to adopt developments in the Schengen/Dublin acquis and therefore must align large parts of its asylum, screening and Eurodac rules with the new European framework. The refreshed page confirms that the Federal Council brought the necessary legislative amendments into force on 12 June 2026 and that Switzerland will begin applying the new screening regulation, expanded Eurodac database and revised Dublin criteria from early 2027. Importantly for employers, the documentation reiterates that the solidarity mechanism – which could oblige states to accept relocated asylum seekers or make financial contributions – remains voluntary for Switzerland, subject to annual parliamentary approval. Operationally, the biggest change for companies moving staff is the shortened timeline for Dublin transfer decisions and the extended responsibility period (from 12 to 20 months) for an asylum seeker who entered Switzerland irregularly. Corporate immigration teams should review internal SOPs to ensure any humanitarian or intra-company transfers consider the tighter deadlines. The update also notes that biometric collection will be expanded to children from age six and that Eurodac will interoperate with ETIAS and the Entry-Exit System—data-privacy points that legal and HR departments will need to address in consent forms and retention policies. While the SEM text stresses that Switzerland will not run border asylum procedures at EU external frontiers, it will apply comparable accelerated processes domestically. Stakeholders have until mid-November to comment on implementing ordinances; thereafter, cantonal migration offices will issue detailed circulars. Multinationals are advised to monitor these for any new documentary requirements or appointment-booking systems that could affect assignee lead times.
