In an unexpected move during its 7 October sitting, the Council of States (Switzerland’s upper chamber) adopted a motion that would allow Regional Employment Centres (RAV) to sanction employers who choose a foreign candidate when a suitably qualified resident is available. The proposal, tabled by Centre-Party senator Benedikt Würth, was approved by 37 votes to five and now heads to the National Council. If enacted, companies that breach the rule could face administrative fines and—more critically for internationally active businesses—temporary exclusion from the federal quota for third-country work permits. Under Switzerland’s dual immigration system, non-EU/EFTA talent can only be hired when jobs cannot be filled locally or within the EU/EFTA pool; the new measure would tighten that requirement further by empowering labour offices to police dubious hiring decisions in real time. Supporters argue the step is necessary as unemployment among young Swiss graduates has ticked up and public pressure is mounting to “mobilise domestic workforce potential” before resorting to global recruitment. Critics, including the Federal Council, warn that intrusive oversight may hamper companies’ agility, especially in sectors where niche skills are scarce. They also fear the measure could complicate intra-group transfers relied on by multinationals headquartered around Zurich, Basel and Geneva. For global mobility managers the take-away is clear: any Swiss hiring strategy that envisages third-country nationals will have to be backed by watertight labour-market tests and documentation demonstrating the absence of qualified local candidates. Failure to do so could not only trigger fines but jeopardise the company’s future access to the precious (and chronically oversubscribed) B-permit quota, potentially derailing entire assignment pipelines.
