The Home Office has unveiled a long-awaited safeguard for foreign nationals who come to Britain under the Skilled Worker route but find themselves trapped by abusive sponsors. Published on 9 October 2026, the new rules allow any sponsored worker who can show credible evidence of labour exploitation—such as withholding of wages, coercion to work excessive hours or confiscation of documents—to change employer immediately without first securing a fresh Certificate of Sponsorship. They will be granted a 60-day grace period in which to lodge a new visa application and may undertake any lawful employment during that window, provided the job is not as a professional sportsperson. The reform follows a series of high-profile cases in the social-care and hospitality sectors and criticism that the sponsorship system gives rogue employers disproportionate control. Campaigners such as FLEX and the Recruitment & Employment Confederation have argued that fear of losing immigration status deters victims from reporting abuse. For UK businesses the change removes the risk of sudden labour shortages if a supplier is sanctioned for exploitation, but it also means greater scrutiny of HR practices: companies inheriting a transferee must complete a fresh right-to-work check and report the new hire on the Sponsorship Management System (SMS) within 10 working days. Employers who become aware of abuse now have a statutory duty to report it or risk civil penalties of up to £60,000. Practically, mobility managers should review onboarding workflows so that offer letters, salary payments and working-time records can be produced quickly if UKVI investigates. Multinationals that use third-party labour providers should ensure contracts explicitly prohibit fees being charged to workers and provide audit rights so that issues are detected before they become enforcement cases.
